(11-11-24) On November 10, 2024 at approximately 7:43 PM Darke County Deputies along with Union City Police Department, Greenville Rescue, Union City Fire and Rescue were dispatched to 868 Wasson Road (Union City Country Club) in reference to a UTV that struck several pedestrians.

Carolyn Stewart

Preliminary investigation revealed a 2020 Uforce side-by-side, driven by Carolyn Stewart (64) of Union City, Indiana was parked in the grass area on the east side of the clubhouse. Stewart attempted to back the side-by-side up when she struck two elderly pedestrians, Thomas Brewer (77) and Tonya Puccini (69) both from Union City, Indiana.

Brewer was transported to Wayne Healthcare where he was treated and released. Puccini was taken to Miami Valley Hospital by Miami Valley’s MICU (Mobile Intensive Care Unit) where her condition is unknown at this time. Both CareFlight and MedFlight were called to the scene however, unable to fly due to weather conditions.

Stewart was arrested on charges of Aggravated Vehicular Assault and Operating a Vehicle Impaired. Stewart was transported to the Darke County Sheriff’s Office jail.

Aggravated vehicular assault is a third-degree felony and carries with it a mandatory minimum one year prison term and a potential range of prison between 1-5 years – any time imposed is mandatory time. The judge is required to suspend the defendant’s driver’s license for at least 2 years and could suspend the license for 10 years.

Aggravated vehicular assault is elevated from a third-degree felony to a second-degree felony if any of the following apply:

  • At the time of the offense, the individual was driving under a suspended driver’s license.
  • The individual had previously been convicted of or pled guilty to a violation of aggravated vehicular assault or vehicular assault.
  • The individual had previously been convicted of or pled guilty to any traffic-related homicide, manslaughter, or assault offense.
  • The individual had previously been convicted of or pled guilty to three or more DUIs.
  • The individual had previously been convicted of or pled guilty to a second or subsequent felony DUI.
