(9-23-22) Mark Burgoon (50) received a suspended 180 day jail sentence this week in Mercer County Common Pleas Court after pleading guilty to a 1st degree misdemeanor charge of telecommunications harassment.
In a plea deal, a 5th degree felony charge of unauthorized use of the Law Enforcement Automated Data System (LEADS) was dropped.
Burgoon was not fined…butmust also avoid jailable offenses for the next 2 years and pay court costs.
Burgoon, a former member of the Celina Police Department and now retired, used the police database to identify people that were friends of his wife. Under Ohio law, accessing the system for anything other than law enforcement use is a felony.
The State was represented by Special Prosecuting Attorney Eva Yarger and Burgoon was represented by his attorney Thomas Lucente.
