Dog St Marys

(12-11-17) The Ohio Third District Court of Appeals has affirmed a ruling by Auglaize Municipal Court  that the City of St. Marys (dangerous) dog ordinance is unconstitutional, since it was in conflict with Ohio state law. The court said in its ruling ‘that the city exceeded its powers under the Home Rule Amendment‘ The court of appeals issued the ruling Monday December 11th.

The City appealed the initial judgement in early July (2017).  Shawn Mullins sued the city after declaring that his dog was a “Dangerous Dog” under the city’s dog ordinance.
