David Elkins

(3-5-24) Yesterday the Mercer County Sheriff’s Office booked David Elkins (57) on a 1st degree felony charge of rape. He is being held in the Mercer County Adult Detention Center, with no bond) waiting for a hearing in the Mercer County Common Pleas Court.

Van Wert County Sheriff’s Deputies served a Warrant at 9am yesterday issued by Mercer County at a location on Skinner Street in the Village of Ohio City. David Alan Elkins of rural Rockford was arrested on several felony charges including Aggravated Burglary and Rape. He was transported to the Mercer County Line and turned over to the Mercer County Sheriff.

He was arrested on January 30th, 2024 on a 1st degree misdemeanor domestic violence charges and was released on bond on January 31st. He is scheduled for a court hearing on March 12th at Celina Municipal Court

Penalties for Rape in Ohio

The potential punishments for Ohio rape depend on a number of different factors but ALL are considered First Degree Felonies.

Sentences range from:

  • A mandatory 3-11 years if someone is convicted of administering/drug/intoxicant or by force if the defendant is less than 16 at the time of the offense and did not cause serious physical harm to the victim and the victim was 10 or older; the ability to resist was impaired by a mental or physical condition;
  • A minimum of 5 years up to 11 years if someone is found to have administered a scheduled controlled substance;
  • A mandatory 10 years to Life if the victim was under the age of 13;
  • A mandatory 15 years to Life if the victim was under the age of 10;
  • A mandatory 25 to Life OR Life Without Parole if the victim was under the age of 13 and the offender caused serious physical harm, or if the victim was 13 and the offender used force or a threat of force.
